Bu Kullanım Şartları ("Şartlar"), Pancarlabs ("biz") tarafından sunulan
MyFitExpert mobil uygulamasının ("Uygulama") kullanımını düzenler. Uygulamayı indirerek,
açarak veya kullanarak bu Şartları kabul etmiş sayılırsın. Kabul etmiyorsan Uygulamayı kullanma.
1. Hizmetin Tanımı
MyFitExpert, kişiselleştirilmiş antrenman ve beslenme planları, kalori/makro takibi, vücut ölçüm
kaydı ve AI destekli yemek analizi gibi özellikler sunan bir fitness ve yaşam tarzı uygulamasıdır.
Bazı özellikler ücretli abonelik gerektirir.
2. Tıbbi Uyarı
MyFitExpert tıbbi cihaz değildir ve tıbbi tavsiye sağlamaz. Sunulan tüm bilgiler,
antrenman planları, beslenme önerileri ve hesaplamalar yalnızca genel bilgilendirme
amacıyla sunulur. Yeni bir antrenman programına veya diyete başlamadan önce — özellikle herhangi bir
sağlık sorunun, hamileliğin veya tıbbi durumun varsa — mutlaka uzman bir sağlık profesyoneline
danışmalısın. Uygulamayı kullanırken oluşabilecek yaralanma veya sağlık sorunlarından biz
sorumlu tutulamayız.
3. Yaş Sınırı
Uygulamayı kullanabilmek için en az 13 yaşında olmalısın. 18 yaş altıysan, hesap
oluşturmak için veli/vasi izniyle hareket etmelisin. Uygulama hamilelere veya altta yatan ciddi
sağlık sorunu olan kişilere yönelik tasarlanmamıştır; bu durumlarda kullanım önerilmez.
4. Hesap ve Güvenlik
Hesap oluştururken doğru bilgi vermek senin sorumluluğundadır.
Hesap güvenliğini sağlamak (örn. cihaz şifresi, e-posta erişimi) sana aittir.
Hesabının izinsiz kullanıldığını fark edersen derhal bize bildirmelisin.
Bir hesabı paylaşamaz, satamaz veya başkasına devredemezsin.
5. Abonelik ve Ödeme
Premium özellikler haftalık, aylık, 3 aylık, 6 aylık veya yıllık abonelik ile sunulur.
Ödeme, satın alma onayında App Store / Google Play hesabından tahsil edilir.
Abonelik, mevcut dönemin bitiminden en az 24 saat önce iptal edilmediği sürece
aynı fiyat ve süreyle otomatik olarak yenilenir.
Yenileme ücreti, dönemin bitiminden önceki 24 saat içinde tahsil edilir.
Aboneliğini istediğin zaman cihazının App Store / Google Play ayarlarından yönetebilir veya
iptal edebilirsin.
Ücret iadeleri Apple ve Google'ın iade politikalarına tabidir; doğrudan biz iade işlemi
yapamayız.
Kullanılmamış bir deneme süresi, ücretli aboneliğe geçişinde iptal edilir.
6. Kabul Edilen Kullanım
Uygulamayı kullanırken şunları yapmamayı kabul edersin:
Yasalara aykırı amaçlar için kullanmak,
Uygulamayı tersine mühendislik yapmak, kopyalamak veya türev çalışma oluşturmak,
Otomatik araçlarla (bot, scraper) verilere erişmeye çalışmak,
Uygulamanın güvenlik mekanizmalarını atlatmaya çalışmak,
Başka kullanıcıların hesaplarına izinsiz erişmek,
Zararlı kod (virüs, malware) yüklemek veya bulaştırmaya çalışmak.
7. Kullanıcı İçeriği
Uygulamaya yüklediğin yemek fotoğrafları, ölçümler ve diğer girdiler senin mülkiyetinde kalır.
Bu içeriği yalnızca sana hizmet sunmak (AI analizi, plan kişiselleştirme) amacıyla işleriz ve
kalıcı olarak yedeklemez veya üçüncü taraflarla paylaşmayız (Gizlilik Politikası'nda belirtilen
işleyiciler hariç).
8. Fikri Mülkiyet
Uygulamanın kendisi, tasarımı, kaynak kodu, logoları, marka adları ve tüm içerikleri Pancarlabs'in
veya lisans verenlerinin mülkiyetindedir ve telif hakkı, ticari marka ve diğer fikri mülkiyet
yasalarıyla korunmaktadır. Sana yalnızca kişisel, ticari olmayan, devredilemez ve geri alınabilir
bir kullanım lisansı verilir.
9. Üçüncü Taraf Hizmetler
Uygulama; Apple, Google (Gemini AI ve Analytics dahil), Clerk, RevenueCat, Cloudflare gibi üçüncü taraf hizmetler kullanır.
Bu hizmetlerin kendi kullanım şartları ve gizlilik politikaları geçerlidir; onların eylem veya
ihmallerinden sorumlu değiliz.
10. Sorumluluğun Sınırlandırılması
Uygulama "olduğu gibi" ve "kullanılabilir olduğu ölçüde" sunulur.
Yürürlükteki yasaların izin verdiği azami ölçüde, Pancarlabs:
Uygulamanın kesintisiz veya hatasız çalışacağını,
AI çıktılarının veya hesaplamaların kusursuz olduğunu,
Uygulamanın belirli bir sağlık veya fitness sonucunu garanti ettiğini
garanti etmez. Uygulamanın kullanımından kaynaklanan dolaylı, arızi, sonuç olarak ortaya çıkan
zararlardan sorumlu değiliz. Toplam sorumluluğumuz, son 12 ayda bize ödediğin abonelik ücretiyle
sınırlıdır.
11. Hesabın Feshi
Hesabını uygulama içinde Profil → Hesabı Sil seçeneğiyle istediğin zaman silebilirsin.
Bu Şartları ihlal ettiğin durumlarda hesabını bildirimsiz olarak askıya alabilir veya
kapatabiliriz.
Hesabı silindikten sonra ödenmiş abonelik dönemi otomatik iade edilmez; mevcut dönem sonuna
kadar erişimin sürebilir.
12. Değişiklikler
Bu Şartları gerektiğinde güncelleyebiliriz. Önemli değişiklikler uygulama içi bildirim veya e-posta
ile size iletilir. Değişiklik sonrası Uygulamayı kullanmaya devam etmen güncellenmiş Şartları kabul
ettiğin anlamına gelir.
13. Uygulanacak Hukuk ve Yetki
Bu Şartlar Türkiye Cumhuriyeti yasalarına tabidir. Uyuşmazlık halinde, tüketici haklarından doğan
davalar saklı kalmak kaydıyla İstanbul Mahkemeleri ve İcra Daireleri yetkilidir.
14. Apple App Store Ek Hükümleri
Aşağıdaki ek hükümler, Uygulamayı Apple App Store üzerinden edindiysen geçerlidir. Bu Şartların
yalnızca seninle Pancarlabs arasında olduğunu ve Apple Inc. ("Apple") ile olmadığını
kabul edersin. Uygulamadan ve içeriğinden Apple değil, yalnızca Pancarlabs sorumludur.
Lisans Kapsamı. Madde 8'de sana verilen lisans; Uygulamayı sahip olduğun veya
kontrol ettiğin Apple markalı ürünlerde, Apple Media Services Hüküm ve Koşullarındaki Kullanım
Kuralları çerçevesinde kullanmak üzere devredilemez bir lisansla sınırlıdır. Aile Paylaşımı veya
toplu satın alma yoluyla seninle ilişkili diğer hesaplar Uygulamaya erişebilir.
Bakım ve Destek. Uygulamaya yönelik tüm bakım ve destek hizmetlerini sağlamaktan
yalnızca Pancarlabs sorumludur. Apple'ın herhangi bir bakım veya destek sağlama yükümlülüğü yoktur.
Garanti. Yasal olarak geçerli biçimde reddedilmediği ölçüde, açık veya zımni her
türlü ürün garantisinden yalnızca Pancarlabs sorumludur. Uygulamanın geçerli bir garantiye uymadığı
durumlarda Apple'a bildirimde bulunabilirsin; Apple, Uygulamanın satın alma bedelini (varsa) sana
iade edecektir. Geçerli hukukun izin verdiği azami ölçüde, Apple'ın Uygulamaya ilişkin başkaca hiçbir
garanti yükümlülüğü olmayacak; herhangi bir garantiye uymama nedeniyle doğan diğer talep, kayıp,
sorumluluk, zarar, maliyet ve giderler yalnızca Pancarlabs'in sorumluluğunda olacaktır.
Ürün Talepleri. Uygulamaya veya Uygulamayı bulundurman/kullanmana ilişkin her
türlü talebi (ürün sorumluluğu talepleri; Uygulamanın geçerli yasal veya düzenleyici şartlara
uymadığı yönündeki talepler; tüketici koruma, gizlilik veya benzer mevzuat kapsamındaki talepler
dahil) ele almakla Apple değil, yalnızca Pancarlabs yükümlüdür.
Fikri Mülkiyet İhlali Talepleri. Uygulamanın veya Uygulamayı bulundurman ve
kullanmanın bir üçüncü tarafın fikri mülkiyet haklarını ihlal ettiği iddiasıyla bir talep gelmesi
durumunda, söz konusu talebin soruşturulması, savunulması, uzlaşılması ve sonuçlandırılması yalnızca
Pancarlabs'in sorumluluğundadır; Apple'ın bu konuda yükümlülüğü yoktur.
Hukuka Uygunluk. (i) ABD Hükümeti tarafından ambargo uygulanan ya da "terörü
destekleyen" ülke olarak tanımlanmış bir ülkede bulunmadığını ve (ii) ABD Hükümetinin yasaklı veya
kısıtlı taraflar listelerinin hiçbirinde yer almadığını beyan ve taahhüt edersin.
Üçüncü Taraf Yararlanıcı. Apple ve iştiraklerinin bu Şartların üçüncü taraf
yararlanıcısı olduklarını ve bu Şartları kabul etmenin ardından Apple'ın bu Şartları sana karşı
üçüncü taraf yararlanıcısı sıfatıyla uygulama hakkına sahip olacağını (ve bu hakkı kabul etmiş
sayılacağını) kabul edersin.

These Terms of Use ("Terms") govern your use of the MyFitExpert mobile
application ("App") provided by Pancarlabs ("we", "us"). By downloading, opening
or using the App you agree to these Terms. If you do not agree, do not use the App.
1. The Service
MyFitExpert is a fitness and lifestyle app offering personalized workout and nutrition plans,
calorie/macro tracking, body measurement logging and AI-assisted meal analysis. Some features
require a paid subscription.
2. Medical Disclaimer
MyFitExpert is not a medical device and does not provide medical advice.
All information, workout plans, nutrition suggestions and calculations are provided for
general informational purposes only. Before starting a new exercise program or
diet — especially if you have a health condition, are pregnant, or have any medical concerns —
you should consult a qualified healthcare professional. We are not responsible
for any injury or health issue that arises from your use of the App.
3. Age Requirement
You must be at least 13 years old to use the App. If you are under 18, you may
only create an account with the consent of a parent/guardian. The App is not designed for use by
pregnant individuals or those with serious underlying health conditions; use is not recommended
in those cases.
4. Account and Security
You are responsible for providing accurate information when creating an account.
You are responsible for safeguarding your device, password and email access.
Notify us promptly of any unauthorized use of your account.
You may not share, sell or transfer your account.
5. Subscriptions and Payment
Premium features are offered as weekly, monthly, 3-month, 6-month or annual subscriptions.
Payment is charged to your App Store / Google Play account upon
confirmation of purchase.
The subscription renews automatically at the same price and period unless canceled
at least 24 hours before the end of the current period.
Renewal is charged within 24 hours before the period ends.
You can manage or cancel your subscription anytime in your device's App Store / Google Play
settings.
Refunds are subject to Apple's and Google's refund policies; we cannot issue refunds directly.
Any unused free trial period is forfeited when you upgrade to a paid subscription.
6. Acceptable Use
When using the App you agree not to:
Use it for any unlawful purpose,
Reverse engineer, copy or create derivative works of the App,
Access data using automated means (bots, scrapers),
Circumvent the App's security mechanisms,
Access another user's account without authorization,
Upload or transmit malicious code (viruses, malware).
7. User Content
Meal photos, measurements and other inputs you upload remain your property. We process this
content solely to provide the service (AI analysis, plan personalization) and do not store it
indefinitely or share it with third parties (other than the processors listed in the Privacy
Policy).
8. Intellectual Property
The App itself, its design, source code, logos, brand names and all content are owned by
Pancarlabs or its licensors and are protected by copyright, trademark and other intellectual
property laws. You are granted only a personal, non-commercial, non-transferable, revocable
license to use the App.
9. Third-Party Services
The App uses third-party services such as Apple, Google (including Gemini AI and Analytics), Clerk, RevenueCat and Cloudflare.
Their own terms and privacy policies apply; we are not responsible for their acts or omissions.
10. Limitation of Liability
The App is provided "as is" and "as available". To the maximum
extent permitted by law, Pancarlabs does not warrant that:
The App will be uninterrupted or error-free,
AI outputs or calculations will be flawless,
The App will achieve any specific health or fitness outcome.
We are not liable for indirect, incidental or consequential damages arising from your use of
the App. Our total liability is limited to the subscription fees you paid us in the last 12 months.
11. Termination
You may delete your account at any time in-app via Profile → Delete Account.
We may suspend or terminate your account without notice if you violate these Terms.
Paid subscription periods are not automatically refunded upon account deletion; your access
may continue until the end of the current period.
12. Changes
We may update these Terms when necessary. Material changes will be communicated in-app or by
email. Continuing to use the App after a change means you accept the updated Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Türkiye. Without prejudice to mandatory
consumer-rights remedies, the courts and execution offices of Istanbul have
exclusive jurisdiction over any dispute.
14. Apple App Store Additional Terms
The following additional terms apply if you obtained the App from the Apple App Store. You
acknowledge that these Terms are between you and Pancarlabs only, and not with
Apple Inc. ("Apple"). Pancarlabs, not Apple, is solely responsible for the App and its content.
Scope of License. The license granted to you in Section 8 is limited to a
non-transferable license to use the App on any Apple-branded products that you own or control,
and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions,
except that the App may be accessed and used by other accounts associated with you via Family
Sharing or volume purchasing.
Maintenance and Support. Pancarlabs is solely responsible for providing any
maintenance and support services for the App. Apple has no obligation whatsoever to furnish any
maintenance or support services for the App.
Warranty. Pancarlabs is solely responsible for any product warranties, whether
express or implied by law, to the extent not effectively disclaimed. In the event of any failure
of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the
purchase price for the App to you (if any). To the maximum extent permitted by applicable law,
Apple will have no other warranty obligation whatsoever with respect to the App, and any other
claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to
any warranty will be Pancarlabs's sole responsibility.
Product Claims. Pancarlabs, not Apple, is responsible for addressing any claims
relating to the App or your possession and/or use of the App, including but not limited to:
(i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal
or regulatory requirement; and (iii) claims arising under consumer protection, privacy or similar
legislation.
Intellectual Property Rights. In the event of any third-party claim that the
App or your possession and use of the App infringes that third party's intellectual property
rights, Pancarlabs, not Apple, will be solely responsible for the investigation, defense,
settlement and discharge of any such claim.
Legal Compliance. You represent and warrant that (i) you are not located in a
country that is subject to a U.S. Government embargo, or that has been designated by the U.S.
Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government
list of prohibited or restricted parties.
Third-Party Beneficiary. You acknowledge and agree that Apple and Apple's
subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these
Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these
Terms against you as a third-party beneficiary.
